  1. Introduction

    Welcome to BulkBuddy ("we," "us," or "our"). By downloading or using our mobile application ("App"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). Please read these Terms carefully. If you do not agree to these Terms, do not use the App.

  2. Use of the App
    • Eligibility: You must be at least 13 years old to use our App. By agreeing to these Terms, you represent that you are at least 13 years of age or older. If you are under 13, you are prohibited from creating an account or using the App.
    • Account Registration: To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information when creating your account and to update it as necessary. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device.
  3. User Conduct and Responsibilities

    You agree to use the App only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the App. You agree not to:

    • Use the App for any fraudulent or unlawful purpose.
    • Upload or share any content that is illegal, harmful, or offensive.
    • Attempt to gain unauthorized access to the App, other accounts, or computer systems or networks connected to the App.

    In the future, when social sharing features are available, you are responsible for any content you share. We reserve the right to remove any content that we determine to be inappropriate, harmful, or in violation of these Terms.

  4. User-Generated Content

    If you submit or share any content within the App, such as workout logs or comments ("User Content"), you retain ownership of that content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, modify, and distribute such content within the App as needed to provide and improve the App’s functionality. We reserve the right to remove any User Content that violates these Terms.

  5. Data Collection and Privacy

    We collect and process personal data as described in our Privacy Policy, which can be found here. By using the App, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

  6. Intellectual Property

    All content, features, and functionality within the App, including text, graphics, logos, icons, and images, are the property of BulkBuddy or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, or distribute any content from the App without our prior written permission.

  7. Third-Party Services

    The App may contain links to or integrate with third-party services, such as Google Sign-In or Firebase. These services are governed by their own terms and privacy policies. We are not responsible for the content or practices of these third parties, and your interactions with them are at your own risk.

  8. Updates and Maintenance

    We reserve the right to modify or discontinue, temporarily or permanently, the App or any part of it without notice. While we aim to minimize downtime, there may be occasions where access is interrupted for updates or maintenance. We will not be liable for any modification, suspension, or discontinuation of the App.

  9. Subscription Services and In-App Purchases

    In the future, we may offer subscription services or in-app purchases. These services will be processed through the iOS App Store (and, eventually, the Google Play Store) in accordance with their respective terms. All payments and refunds will be handled directly through these platforms, and we will not be responsible for payment processing or related issues.

  10. Data Security

    We take reasonable measures to protect your data. BulkBuddy uses Firebase’s authentication and storage solutions, which include encryption practices that secure user passwords and data in transit. While we take these precautions, it is essential that you maintain the confidentiality of your account details.

  11. Limitation of Liability

    To the fullest extent permitted by law, BulkBuddy and its affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, use, goodwill, or other intangible losses arising from your use or inability to use the App.

  12. Indemnification

    You agree to indemnify and hold harmless BulkBuddy and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the App, violation of these Terms, or infringement of any rights of another.

  13. Dispute Resolution

    In the event of a dispute, you agree to resolve it through binding arbitration rather than court proceedings. This agreement to arbitrate applies to all claims and disputes related to the use of the App, except for matters involving intellectual property rights or where arbitration is prohibited by law.

  14. Jurisdiction

    These Terms are governed by and construed in accordance with the laws of the United States. Any legal actions or proceedings related to these Terms shall be instituted exclusively in the United States, and you consent to the jurisdiction of such courts.

  15. Data Breach Policy

    In the event of a data breach, we will notify affected users promptly and take appropriate measures to secure the data. Users will be notified via email and/or an in-app notification to inform them of the breach and any necessary actions.

  16. Children's Privacy

    Our App is not intended for use by children under the age of 13. We do not knowingly collect personal information from children under 13. If you become aware that a child has provided us with Personal Data, please contact us.

  17. Changes to These Terms

    We reserve the right to update or modify these Terms at any time. We will notify you of any changes by updating the "Last updated" date at the top of these Terms. Your continued use of the App after any changes indicates your acceptance of the new Terms.
